Digital Millennium Copyright Act (DMCA) Policy

Find Joy in the Chaos & FindJoyInTheChaos.com (“we,” “us,” or “our”), a division of Clinician’s Cache, LLC, respects the intellectual property rights of others and expects users of our website (“the Site”) to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), we will respond expeditiously to claims of copyright infringement committed using the Site if such claims are reported to our designated Copyright Agent as described below.

The DMCA

Providing Accurate Information

When filing a DMCA takedown notice, it is critical that you provide accurate information under penalty of perjury. Submitting false claims may result in legal penalties, including potential damages. Before submitting a DMCA notice, please ensure that the content you are reporting is not authorized by the copyright owner, its agent, or by law (such as under fair use).

Conduct an Investigation

We recommend that copyright owners conduct a thorough investigation to determine whether the use of the copyrighted material is infringing, or whether it may be protected by fair use or other legal doctrines. If possible, we encourage you to resolve disputes with the content uploader directly before filing a formal notice.

No Automated Takedown Requests

We do not accept DMCA notices submitted through automated bots or software. Each DMCA notice should be carefully reviewed by a trained professional to ensure its validity and accuracy. Automated submissions may lead to invalid notices and wrongful removal of content, which may expose the submitter to legal liability.

Counter-Notices

If we remove or disable access to content in response to a DMCA takedown notice, we will make a good-faith attempt to notify the user who posted the content about the removal. If you believe your content was wrongfully removed, you may submit a counter-notice, following the procedure outlined below.

Limited Discretion in Processing

FindJoyInTheChaos.com exercises limited discretion when processing DMCA notices and counter-notices. We reserve the right to remove or disable access to allegedly infringing content without prior notice. Additionally, in compliance with the DMCA, we may terminate users who are deemed repeat infringers.

Submitting a DMCA Takedown Notice

If you believe that content on our Site infringes your copyright, you may send a DMCA Takedown Notice to our designated Copyright Agent. The notice must include the following:

Your Contact Information:

  • Full legal name (as your physical or electronic signature)
  • Mailing address
  • Telephone number
  • Email address

Identification of the Copyrighted Work:

  • A description of the copyrighted work that you claim has been infringed.
  • If multiple copyrighted works are involved, you may provide a representative list of such works.

Identification of the Infringing Material:

  • A description of where the allegedly infringing material is located on the Site. Please include URLs or any other relevant details to help us locate the content.

Statement of Good Faith:

  • A statement that you have a good-faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or by law.

Statement of Accuracy and Authority:

  • A statement, made under penalty of perjury, that the information provided in the notice is accurate, and that you are the copyright owner or authorized to act on the owner’s behalf.

Note: By submitting a DMCA notice, you acknowledge that a copy of your notice, including any contact information provided, may be sent to the user who posted the allegedly infringing content.

Submitting a DMCA Counter-Notice

If you believe that your content was removed or disabled due to a mistake or misidentification, you may submit a counter-notice. Your counter-notice must include the following information:

Your Contact Information:

  • Full legal name (as your physical or electronic signature)
  • Mailing address
  • Telephone number
  • Email address

Identification of the Material Removed:

  • A description of the material that was removed or to which access was disabled.
  • The location (e.g., specific URLs) where the material appeared before it was removed or disabled.

Statement Under Penalty of Perjury:

  • A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.

Consent to Jurisdiction:

  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the U.S., for any judicial district in which FindJoyInTheChaos.com may be found.
  • A statement that you will accept service of process from the person who provided the original DMCA notice or their agent.

Upon receipt of a valid counter-notice, we will forward a copy to the original complainant. If we do not receive notice from the original complainant within 14 business days indicating that they are seeking a court order to prevent further infringement, we may restore the removed content.

Repeat Infringers

In accordance with the DMCA and applicable law, we have adopted a policy of terminating, when appropriate, users who are deemed to be repeat infringers. At our sole discretion, we may also limit access to the Site or terminate the accounts of users who infringe any intellectual property rights, whether or not repeat infringers.

Changes to This Policy

We reserve the right to modify or replace this DMCA Policy at any time. Any changes will be effective immediately upon posting to this page. Your continued use of the Site after any such changes constitutes your acceptance of the updated DMCA Policy.
